These Terms of Service ("Terms") govern your use of the OptiPixl service ("Service") operated by OptiPixl ("we", "us", or "our"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using OptiPixl, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

OptiPixl provides automatic image optimization and delivery services for WordPress websites. The Service includes:

  • Automatic image resizing and format conversion
  • Global content delivery network (CDN) for image delivery
  • WordPress plugin for integration
  • Dashboard for account management and analytics

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

  • Upload, transmit, or distribute illegal content
  • Infringe on intellectual property rights
  • Distribute malware or malicious code
  • Attempt to gain unauthorized access to our systems
  • Overload or disrupt the Service infrastructure
  • Use the Service for any unlawful purpose

5. Content Ownership

You retain ownership of all content you upload to the Service. By using OptiPixl, you grant us a limited license to process, transform, cache, and deliver your images as necessary to provide the Service.

We do not claim ownership of your content and will not use your images for any purpose other than providing the Service.

6. Pricing and Payment

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specifically stated in these Terms.

We offer a 14-day money-back guarantee on all paid plans. If you're not satisfied within the first 14 days, contact us for a full refund.

We reserve the right to change our pricing. Any price changes will be communicated at least 30 days in advance and will apply to subsequent billing periods.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may occasionally need to perform maintenance or updates that temporarily affect availability.

The Service is designed to fail safely. If optimization is unavailable, your original images will be served automatically.

8. Limitation of Liability

To the maximum extent permitted by law, OptiPixl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless OptiPixl and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

You may terminate your account at any time from the dashboard. We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will cease immediately. Your original images remain on your WordPress server and are not affected by termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.
